RULES OF THE GAME WITHOUT OBLIGATION TO PURCHASE “ELHEE & FRIENDS”

Article 1: object

The company Elhée SAS, whose head office is located at 4 rue Clara Belle 38160 Saint-Marcellin, represented by Allison Piraud in her capacity as Founder, is organizing from April 22, 2024 to April 28, 2024 (inclusive), a game with no obligation to purchase entitled “Élhée & Friends” (hereinafter the “ Game ”), according to the terms described in these regulations.

The Game is not sponsored or managed by Instagram. Consequently, any comments, questions or complaints concerning the Game must be addressed to the Organizing Company and not to Instagram. The information communicated by participants is provided to the Organizing Company and not to Instagram.

Article 2 – PARTICIPATION

2.1. Access to the Game

The Game is open to any adult natural person residing in mainland France and Europe (hereinafter the “ Participant ”), with the exception of staff members of the Game organizing structures, and any person who has participated directly or indirectly. to its organization or its realization, as well as their spouse (marriage, PACS, cohabitation) and members of their family: direct lineal ascendants and descendants.

Participation in the Game is limited to a single participation per household (same name, same address) and per day for the entire duration of the Game. Participation is strictly nominative and the Participant may under no circumstances play under several pseudonyms or on behalf of other people.

The Organizing Company reserves the right to ask any Participant to provide proof of these conditions. Any Participant not meeting these conditions or refusing to justify them will be excluded from the Game and will not be able, in the event of a win, to benefit from their prize.

Likewise, any false declaration, indication of identity or address will result in the immediate elimination of the Participant and, where applicable, the reimbursement of the lot(s) which have already been sent to him/her. ).

Participation in the Game implies full acceptance of these regulations.

2.2. Conditions of participation

As such, the Participant must have an internet connection and an Instagram account. No registration can be made by telephone, fax, postal mail or email.

To participate, simply follow Élhée's Instagram account (@elhee_france) as well as all the other accounts of the participating brands and invite friends to participate in comments under the competition post. The Participant can also play by registering their email address on the dedicated page, they then agree to receive marketing emails from the brands participating in the competition.

The Participant's personal account must be made public for the duration of the game. 2 winners will be designated by a random draw carried out by the Organizing Company among the posts of all Participants and among the emails collected on the Landing Page, within a period of 10 (ten) days following the end of the Game will be entitled to prize money under the conditions referred to in article 4 of these regulations.

2.3. Validity of participation

The information and contact details provided by the Participant must be valid and sincere, under penalty of exclusion from the Game and, where applicable, loss of status as winner.

It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the Game devices, in order to modify the results or to influence the designation of a winner by automated and/or unfair means.

Each Participant is prohibited from using, directly or indirectly, any method of interrogation or systematized request from the social network Instagram.

In the event that a Participant has apparently won a prize in contravention of these regulations, by fraudulent means, such as an automated search (for example: search, participation, automated management software, or the use of 'an algorithm etc.) or unfair (for example: registration in mutual aid or vote exchange groups or any similar process), or by any means other than those resulting from the process described by the Organizing Company in these regulations , his prize would not be awarded to him and would remain the property of the Organizing Company, without prejudice to any legal proceedings that may be brought against the Participant by the Organizing Company or by third parties.

Article 3 – DESIGNATION OF WINNERS – AWARD OF PRIZES

3.1. Designation of winners

The Winner is designated in accordance with the provisions of article 2.2 of these regulations by the Organizing Company, within 10 (ten) days following the end of the Game, i.e. no later than May 8, 2024.

The Organizing Company will inform of the designation of the winners and the conditions for benefiting from the prizes as follows:

By private message on the winner's personal Instagram account used to participate in the Game, which each Participant expressly accepts.

By email with the email used to participate in the Game on the Landing Page.

In this regard, the Organizing Company cannot be held responsible for sending the message to an inaccurate account or an incorrect email address due to an error on the part of the Participant, nor for the malfunction of the message sending device. .

3.2. Allocation of grants

The winner must, by returning to this private message, and within 15 (fifteen) days of the Organizing Company sending the message confirming the winning, indicate the prize they wish to receive (see article 4 above). -after) and communicate their postal details (surname, first name, postal address and telephone number) to be able to receive the lot.

The winner's silence within the aforementioned period will constitute pure and simple renunciation of his prize.

The prize will be sent by post by UPS, DHL or Colissimo within 30 (thirty) days following the sending of the confirmation message sent to the Organizing Company.

The Organizing Company cannot be held responsible for sending the prize to an incorrect address due to an error that the winner made when indicating their postal details, nor for postal delivery problems.

The Organizing Company reserves the right to replace any prize with another prize equivalent in value or characteristics, for any reason whatsoever (in particular in the event of a stock shortage) without its liability being incurred in this regard.

Article 5 – USE OF PERSONAL DATA

5.1. As part of the Game, Participants communicate personal data concerning them to the Organizing Company, which will be the sole recipient.

The personal data of Participants are subject to processing, the controller of which is the company called the “Organizing Company” for the purposes of the Game, whose contact details are indicated in the preamble to these Game rules.

The data collected during participation in the Game is necessary for participation in the Game (pseudonym of the Instagram account, or first and last name of the user serving as the name of the Instagram account) and the data which is collected from the winning Participants is necessary for the allocation of prizes (surname, first name, postal address, telephone number).

Their absence of collection will make any participation in the Game inaccessible and will not allow the allocation of prizes. Participants guarantee the transmission of accurate information and undertake to transmit any changes concerning them as quickly as possible.

The personal data of Participants will be used for the following purposes only: to ensure the proper management of the Game, in accordance with these regulations and to meet legal and regulatory obligations.

5.4. On the condition that the winner has accepted the collection of their personal data in accordance with the preceding provisions, the winner expressly authorizes the Organizing Company to use their contact details (surname, first name, city) for advertising or public relations purposes, on any medium. including the internet, without restriction or reservation, for a maximum period of one (1) year from the closing date of the Game and without this conferring on them any right to remuneration or any advantage other than the attribution of their endowment.

Article 6 – LIMITATION OF LIABILITY

Participation in the Game implies unreserved acceptance of these rules in their entirety, the rules of ethics in force for the Internet, as well as the laws, regulations and other texts applicable in France.

Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the Internet network.

Consequently, the Organizing Company cannot, under any circumstances, be held responsible, without this list being exhaustive:

  • the content of the services consulted on Instagram, and, in general, any information and/or data distributed on the services consulted on Instagram;
  • the transmission and/or reception of any data and/or information on the Internet;
  • any malfunction of the Internet network preventing the smooth running or operation of the Game;
  • failure of any reception equipment or communication lines;
  • loss of any paper or electronic mail and, more generally, loss of any data;
  • routing problems;
  • the operation of any software;
  • the consequences of any virus, computer bug, anomaly, technical failure;
  • any damage caused to a Participant's computer;
  • any technical, hardware or software failure of any nature, which has prevented or limited the possibility of participating in the Game or which has damaged a Participant's system.

It is specified that the Organizing Company cannot be held responsible for any direct or indirect damage resulting from an interruption, a malfunction of any kind, a suspension or the end of the Game, for any reason. whatsoever, or from any direct or indirect damage which may result, in any way, from a connection to Instagram. It is up to all Participants to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack. The connection of any person to Instagram as well as their participation in the Game is done under their entire responsibility.

Article 7 – ACCESS AND INTERPRETATION OF THE REGULATIONS - MODIFICATIONS

7.1. Access

No oral request regarding the Game will be responded to. Any complaint must be sent in writing to the Organizing Company at the address mentioned above before January 2, 2019. After this deadline, no complaint will be accepted.

7.2. Interpretation of the regulations

Any question of application or interpretation of the regulations, or any unforeseen question that may arise, will be decided sovereignly by the Organizing Company.

7.3. Changes

The Organizing Company reserves the right to extend, shorten, modify or cancel the Game at any time, and in particular in the event of force majeure, without the Participants being able to claim any compensation.

Article 8 – APPLICABLE LAW AND JURISDICTION

THIS REGULATION IS SUBJECT TO FRENCH LAW.

ANY DISPUTE RELATING TO THE APPLICATION OR INTERPRETATION OF THESE REGULATIONS WILL, IN THE FAILURE OF AMICABLE SETTLEMENT BETWEEN THE PARTIES, FALL WITHIN THE JURISDICTION OF THE FRENCH COURTS.
