PREAMBLE

These general conditions of sale apply to all orders placed with the company Élhée for all items offered on the elhee.com website by non-commercial individuals (hereinafter the General Conditions of Sale). Consequently, the fact for any person to order a product offered for sale on the Élhée website implies full acceptance of these General Conditions of Sale, which the Customer acknowledges having read prior to his order. Élhée reserves the right to modify these General Terms and Conditions of Sale at any time. Nevertheless, the General Conditions of Sale applicable to the order placed by a Customer on the Élhée site are those accepted by the Customer at the time of placing his order.

ARTICLE 1: ENTIRETY

These General Conditions of Sale express the entirety of the obligations of the parties. In this sense, the Customer is deemed to accept without reservation all the provisions provided for in these General Conditions of Sale.

ARTICLE 2: PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in the context of the online sale of goods offered by the company Élhée to the Customer, from the order to the delivery, including payment and use of services made available by Élhée.

ARTICLE 3 : CHAMP D’APPLICATION

These General Terms and Conditions of Sale govern the sale of products on the day the Customer places an order online.

ARTICLE 4: ORDER

ABILITY TO CONTRACT
Any Customer of the Élhée company declares to have the capacity to contract under the conditions described below, that is to say to be an emancipated minor or to be of legal majority and not to be protected within the meaning of article 488 of the Civil Code. Élhée reserves the right to refuse any order from a Customer with whom a dispute exists or appears during the processing of an order, in particular a payment dispute.

ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER
These General Conditions of Sale can be read directly on the elhee.com website. At the Customer's request, they can also be sent by e-mail. The fact for the Customer to tick the box "I accept the General Conditions of Sale", before proceeding to the secure payment, constitutes an irrevocable acceptance which can only be called into question in the cases exhaustively provided for in these general conditions of sale. sale under the paragraph “right of withdrawal”. PLACING AN ORDER
Individual Customers can place their order with Élhée online 24 hours a day, 7 days a week. The ordering process consists of 6 successive steps. Once the selection of products has been made, and the basket has been validated, the Customer must:

  • indicate the quantities requested.

  • clearly indicate the information required for delivery. This concerns in particular the precise delivery address as well as any accessibility restrictions of the place of delivery (building, floor, digicode, etc.)
  • indicate the delivery method chosen
  • finally, indicate the method of payment chosen.

Once the method of payment has been selected, the Customer must proceed to the payment of his order on the secure interface, which will formalize in a firm and definitive manner the sales contract which binds him to Élhée.
Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below. In all cases, the online provision of the credit card number and the final validation of the order by the Customer will constitute proof of the order and payment of the sums for the products selected in the order. ORDER CONFIRMATION
An e-mail is automatically sent to the Customer to confirm the order taking, provided that the e-mail address indicated in the registration form does not contain an error.
The Customer must verify the completeness and compliance of the information he provides to Élhée. The latter cannot be held responsible for any input errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for reshipment will be borne by the Customer.

ORDER TRACKING
The Customer may at any time consult the status of his order by consulting the “My account” section on the elhee.com website. This tracking allows the Customer to know the processing status of his order, but also the shipping or delivery status of his packages. This last delivery follow-up is carried out in interface with the carriers' Internet means of follow-up. Élhée cannot therefore be held responsible for unavailability or errors that may affect the information provided by its carriers. Élhée nevertheless strives to make this information as clear as possible and to make the transport with its carriers as reliable as possible. The Customer may at any time contact Élhée Customer Service to be informed of the status of his order.

PROOF OF ORDER
The computerized registers, kept in the computer systems of the company Éhée under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. Archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

ARTICLE 5: PRODUCT INFORMATION

PRODUCT CHARACTERISTICS
The information, characteristics, photographs and graphics presented on the elhee.com site or in the emails sent by Élhée are presented with the greatest possible accuracy. Each product sheet presents the essential characteristics of the product selected in accordance with article L.111-1 of the Consumer Code. This information is intended, without being exhaustive, to inform the Customer as completely as possible about the essential characteristics of the products. The Customer is informed, subject to his rights, of the possibility of a difference in presentation on delivery resulting from a modification of the packaging (photograph and illustrations), this difference not affecting in any way the content and the Product Features.

PRODUCT AVAILABILITY
Élhée undertakes to honor orders received only within the limit of available stocks of products or within the limit of stocks available from its suppliers. In the absence of availability of the product(s), Élhée undertakes to inform the Customer as soon as possible. Élhée reserves the right to modify the assortment of products depending in particular on the constraints imposed by its suppliers. Availability may vary within the same day depending on the level of sales. Élhée updates availability very frequently. In the event of unavailability of the products, Élhée will notify the Customer by telephone or e-mail.

The unavailability of a product is mentioned on the page of the product concerned and in the summary of the basket. Thus, the products may appear with the mention of the shipping time of the type "in stock" or "immediate", "4 to 8 days", "1 to 2 weeks", "4 to 6 weeks", "Product not available ” …

The shipping times indicated in the descriptive sheets are indicative times when the product(s) are not available in Elhée stocks. They may therefore undergo variations for which the Customer will be informed by Élhée in his order follow-up in the event of a slight delay or by e-mail in the event of a prolonged delay.

If Élhée cannot obtain a product ordered from its suppliers, the company will notify the customer of the expected delay by e-mail. The latter may then request reimbursement of the sums paid within 14 days at the latest of their payment, either the exchange of the unavailable product for another product, or the cancellation of the order. No cancellation penalty will be applied for such order cancellation. No cancellation compensation (apart from the full refund of the order) may also be requested, such unavailability resulting from the delay in updating these unavailabilities.

Élhée cannot be held responsible for the non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding , fire.

ARTICLE 6: PRICE

The prices are indicated in euros "All Taxes Included" and are only applicable on the date of the sending of validation of the order by the Customer. The prices do not take into account delivery costs, gift wrapping costs, any promotional offers and personal reductions, indicated before the final validation of the order.

The prices take into account the French VAT applicable on the day of the order and any change in the legal VAT rate will be automatically reflected in the price of the products presented on the site, on the date stipulated by the decree of application.

However, prices cannot be changed once the Customer's order has been placed.
Similarly, if one or more taxes or contributions, in particular environmental, were to be created or modified, up or down, this change may be passed on to the selling price of the products present on the elhee.com site.

Orders to countries outside the European Union are not subject to French VAT. The prices indicated on the site for these orders are excluding VAT and therefore do not take into account the VAT. However, these orders are subject to any taxes and customs fees of the country of destination.

ARTICLE 7: PAYMENT

MEANS OF PAYMENT
The Customer can pay for his order online by bank card (Carte Bleue, Visa, Eurocard-Mastercard, Bancontact), or by Paypal. The Customer guarantees the company Élhée that he has the necessary authorizations to use the method of payment chosen by him, during the validation of the order form. Purchases are debited from the Customer's account when the order is processed.

Élhée implements all necessary means to ensure the security and confidentiality of data transmitted online. For this purpose, the site uses a secure method of payment SSL (Secure Socket Layer) which allows the encryption of your bank details during their transmission on the network. You notice that the transmission is encrypted by software when the padlock symbol appears in your browser. The transaction is carried out via the CIC bank, which alone has the banking information provided on the site at the time of payment.

Élhée reserves the right to suspend any order management and any delivery in the event of refusal of authorization of payment by credit card from officially accredited bodies or in the event of non-payment. Élhée reserves the right to refuse to make a delivery or to honor an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. As part of an order verification procedure intended to ensure that no one uses the bank details of another person without their knowledge, the Customer may be asked to send by fax or e-mail to the Élhée company a copy of an identity document as well as proof of residence. The order will only be validated after receipt and verification by our services of the documents sent. In the absence of receipt of these documents within 15 days following the placing of the order, the latter will be deemed canceled automatically.

 

INVOICE
The order form that the Customer establishes online or the order confirmation sent by e-mail to the Customer by Élhée does not serve as an invoice. The Customer has the original of the invoice in his online account. The invoice is not attached to the package. Élhée keeps an electronic copy of each invoice.
In the case of delivery to an address different from the billing address, the invoice is in any case only available in the online order tracking of the Customer's account.

 

TRANSFER OF OWNERSHIP
Élhée remains the owner of the Products delivered until full payment by the Customer. The above provisions do not preclude, upon delivery of the Products, the transfer to the Customer of the risk of loss or deterioration of the Products subject to retention of title as well as the damage they may cause.

ARTICLE 8: DELIVERY

DELIVERY AREAS
The geographical delivery area of the Élhée store offer is as follows:
Metropolitan France, Corsica and Monaco and certain countries in Europe and the rest of the world.
The Customer can contact Élhée's Customer Service for more information on the delivery conditions in a specific country in the world. Orders to countries outside the European Union are not subject to French VAT. However, they are subject to any taxes and customs fees in the country of destination. These costs and the related formalities are the responsibility of the customer/recipient. They are to be paid directly to the carrier upon delivery. The Customer is also responsible for checking the possibilities of importing the products ordered with regard to the law of the country of delivery. We recommend contacting the customs department for more information.

DELIVERY SERVICES
The products are delivered to the address indicated by the Customer on the order form. The Customer must verify the completeness and compliance of the information he provides to Élhée. The latter cannot be held responsible for any input errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for the reshipment of the order will be entirely the responsibility of the Customer.
Élhée cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (including in particular in the event of a total or partial strike, in particular of postal services and means of transport and/or communications).

SHIPPING TIMES
Orders placed online via the elhee.com website are collected every day from Monday to Friday, except public holidays. Élhée does its best to process and ship within 1 working day, however the processing and preparation time for an order can be extended depending on the item and last between 1 and 5 working days. Upon receipt of the shipping confirmation email, the Customer can take into account the delivery times of the carriers announced below. Élhée informs its Customers that these shipping times do not include Saturdays, Sundays and public holidays.
In the case of an order that includes one or more unavailable products as well as one or more available products, Élhée ships the order upon receipt of all the products that make up the order. If the Customer wishes to receive the products available immediately as soon as possible, he is advised to isolate these items in a separate specific order.

TRANSPORT TIMES
Transport times depend on the carrier chosen by the Customer and the place of delivery.
Élhée informs Customers of the deadlines announced by the chosen carrier for information purposes. The shipping costs are calculated according to the country of delivery at the time of the basket and are definitively confirmed according to the mode of transport and the delivery destination chosen, before the final validation of the order. However, Élhée informs its Customers that the announced deadlines do not include Saturdays, Sundays and public holidays.

DELIVERY TIME Delivery times can be as follows:

  • If the products are available, the delivery time is equal to the time indicated when taking the order in the delivery method section.
  • If the products are not available and therefore on order, the delivery time is equal to the time indicated in the product availability section.

If it turns out that the shipping deadline cannot be met, a new deadline will then be communicated to the Customer, based on the data known by Élhée. In this case, a proposal for order cancellation, credit note or refund will also be made to the Customer.

DELIVERY MEANS IN METROPOLITAN FRANCE

Standard delivery by Colissimo (usually observed time of 48h/72h)
This delivery method allows the Customer to receive his package within 48 hours of dispatch thanks to the Post Office and the Colissimo service (excluding order processing and preparation time which can take from 1 to 5 working days). Deliveries are made from Monday to Friday morning, except public holidays. The costs incurred for this option depend on the total weight and volume of the items ordered. The parcel is taken care of by the Post Office and delivered to the delivery address indicated by the Customer. In the event of absence during delivery, a transit advice note is left at the delivery address indicated by the Customer, which allows the latter to collect their package from the nearest post office. Parcels are kept pending at the Post Office for 15 calendar days. In the event of non-collection within the time limits set by the carrier, the products will be returned to Élhée, which reserves the right to refund the price of the products, the shipping costs remaining the responsibility of the Customer.

Delivery by UPS and DHL (usually observed time of 24 hours)
This delivery method allows the Customer to receive his package within 24 hours of dispatch thanks to UPS and DHL (excluding order processing and preparation time which can take 1 to 2 working days). Deliveries are made Monday to Friday, except public holidays. The costs incurred for this option depend on the total weight and volume of the items ordered.
The package is picked up by UPS or DHL and delivered to the delivery address indicated by the Customer. The Customer must ensure that when ordering, he correctly informs the conditions of access to the place of delivery (code, building, floor, door, etc.), as well as a telephone number where the Customer can be easily reached. In case of absence, the deliverer leaves a notice of passage with the indication of his next passage. The Customer may call UPS or DHL customer service to arrange a new delivery date that suits them better. Beyond 3 unsuccessful visits to the delivery address, the package is automatically returned to Élhée, which reserves the right to refund the price of the products.
The delivery times that we indicate are indicative and those generally observed. No refund of shipping costs will be made in the event of delivery within a longer period than those indicated.

 

MEANS OF DELIVERY OUTSIDE METROPOLITAN FRANCE
In Europe and abroad, delivery is made via various carriers: Colissimo, UPS, etc. The costs incurred depend on the country of destination, the weight and the total volume of the items selected. The costs and deadlines are indicated to the Customer before the final validation of his order.
Orders to countries outside the European Union are not subject to French VAT. However, they are subject to any taxes and customs fees in the country of destination. These costs and the related formalities are the responsibility of the customer/recipient. They are to be paid directly to the carrier upon delivery.
The customer is also responsible for checking the possibilities of importing the products ordered with regard to the law of the country of delivery. We recommend contacting the customs department for more information.

CONDITIONING
The products are packaged in such a way as to comply with the transport standards in force, and to ensure optimal protection of the products during their delivery. The Customer is asked to respect these same standards when returning a product, whether during an after-sales service, or when returning for convenience. In the event of a Product return, if we find that the Product returns to us damaged due to insufficient quality packaging, Élhée may decide to only partially reimburse the product or refuse to reimburse it if it is impossible to resale as is.

CUSTOMER RESPONSIBILITY FOR VERIFICATION OF PACKAGES UPON RECEIPT
Élhée reminds that it is the Customer's responsibility to inspect their parcels upon receipt in the presence of the delivery person and to immediately notify the carrier and Élhée Customer Service of any anomaly noted (shock, damaged parcel, delivery date not in accordance with normal deadlines delivery service). In the event that such mentions have not been made on the delivery slip presented to the Customer by the carrier, no complaint relating to the condition of the package(s) could be accepted a posteriori by Élhée.

DELIVERY DELAYS RELATED TO THE CARRIER
In the case of a delay in delivery compared to the deadlines announced by the carriers, the Customer must first contact the carrier or its distribution office in the case of La Poste, to see if the package is not pending. If necessary, the Customer may contact Élhée Customer Service by telephone or e-mail to open a dispute or investigation file to search for the package.
It happens that parcels are misplaced by carriers. The deadlines imposed by the carriers imply that the Customer declares the loss within 10 days of receipt of the shipping notice from Élhée. Under these conditions, Élhée is responsible for making the necessary complaints to the carrier concerned. Once the complaint and the opening of an investigation have been made, it may take 3 to 4 weeks to get a return from the carrier.
If the package is found, it will be forwarded immediately to the Customer's home. In the event that the package is not found, the Customer may then request the return of the same Product (within the time of availability), at the expense of Élhée, or the reimbursement of the amount paid. If the Product(s) ordered were no longer available at that time, Élhée will reimburse the amount of the Products concerned by the loss of the carrier.

DAMAGED PARCELS
The Customer must check the condition of the package before the carrier and make the necessary reservations on the delivery note in the event of partial or total deterioration. In the absence of a reservation, the product is deemed accepted by the Customer and cannot be the subject of any dispute concerning its delivery. The Customer must inform Élhée by e-mail as soon as possible, so that Élhée can take the necessary measures as soon as possible.

ARTICLE 9: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

9.1 Legal withdrawal period
In accordance with the provisions of articles L.221-16 and following of the Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or withdrawal of the products to exercise his right. legal right of withdrawal and thus inform Élhée of its intention to return the said product. If the products can be the subject of the legal right of withdrawal, the Customer exercising his right of withdrawal under the conditions provided for in this article in terms of time and methods of returning the products, may obtain a refund for the returned products.

The refund will be made by the same means of payment as that used by the Customer for the initial transaction. The refund will be made as soon as possible and at the latest within 14 days following the effective exercise of the right of withdrawal by the Customer. However, this period may be extended by Élhée until Élhée receives the goods returned by the Customer to the address indicated on the return form, or until Élhée receives proof of shipment of the Items by the customer. When the fourteen (14) day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day.

In accordance with Article L.221-23 of the Consumer Code, the right is exercised by returning the product, at Élhée's expense for returns from Metropolitan France, failing which the shipping costs remain at the Customer's charge.

Customers can benefit from a prepaid return voucher in the event of lack of conformity of the products delivered with the order (in this case, the return costs will be borne by Élhée).

The right of withdrawal is exercised under the same conditions from the order and before delivery.

9.2 Conventional withdrawal period
In order to ensure the satisfaction of its Customers, Élhée accepts returns by post to the address indicated by Customer Service or on the Delivery slip of the Article concerned, within a period exceeding the legal withdrawal period mentioned above. As such, the Customer has fourteen (14) days from the date of receipt of his order to withdraw and return his products. Product returns beyond this time will not be accepted.

9.4 Modalities for exercising the right of withdrawal

A pre-paid return form will be sent to the Customer to return the products to us unused and in their original packaging.

If the deadlines are not met, Élhée will not be able to reimburse the Customer.
Only products returned in their original packaging in perfect condition for resale will be accepted. Consequently, returns of used products, as well as damaged boxes will be refused.

Withdrawal can never be exercised if the products delivered are products that have been damaged or used. Similarly, these products returned incomplete, damaged or soiled by the Customer will not be taken back or exchanged.

The products must also be accompanied by the order number, either on the return form, sent with the products delivered signed by the Customer, or on any other document. The Customer is informed that the use of the return voucher facilitates the processing of the return by Élhée. The Customer is therefore invited to use this return voucher.

The Customer's liability can only be engaged in the event of depreciation of the product resulting from manipulations other than those necessary to establish the nature, characteristics and, where applicable, the proper functioning of the products.

Reimbursement in the event of use of the right of withdrawal will be made by the same means of payment as that used by the Customer for the initial transaction, unless specifically indicated by the Customer.

ARTICLE 10: GUARANTEES, COMPLAINTS, MEDIATION

GUARANTEE
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof cannot deprive the Customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects of the thing sold. .

The Customer is expressly informed that the company Élhée is not the manufacturer of the products presented within the framework of the elhee.com site, within the meaning of law n ° 98-389 of May 19, 1998 and relating to product liability. defective.

ARTICLE 12: FORCE MAJEURE

Neither party will have failed in its contractual obligations, insofar as their execution is delayed, hindered or prevented by a fortuitous event or force majeure.

If the case of force majeure lasts longer than three months, these general conditions may be terminated by the injured party.
Expressly, are considered as cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals:

ARTICLE 13: PERSONAL DATA
