These general conditions of sale apply to all orders placed with the Élhée company for all items offered on the elhee.com site by non-commercial individuals (hereinafter the General Conditions of Sale). Consequently, the fact of any person ordering a product offered for sale on the Élhée website implies full acceptance of these General Conditions of Sale, of which the Customer acknowledges having read prior to his order. Élhée reserves the right to modify these General Conditions of Sale at any time. However, the General Conditions of Sale applicable to the order placed by a Customer on the Élhée website are those accepted by the Customer at the time of placing their order.

ARTICLE 1: ENTIRETY

ARTICLE 4: ORDER

ABILITY TO CONTRACT
Any Client of the Élhée company declares that they have the capacity to contract under the conditions described below, that is to say, they are an emancipated minor or have the legal majority and are not protected within the meaning of article 488 of the Civil Code. Élhée reserves the right to refuse any order from a Customer with whom a dispute exists or appears during the processing of an order, in particular a payment dispute.

ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER
These General Conditions of Sale can be read directly on the elhee.com website. At the Customer's request, they can also be sent by email. PLACING AN ORDER

Once the payment method has been selected, the Customer must pay for their order on the secure interface, which will firmly and definitively formalize the sales contract that binds them to Élhée.
Any order constitutes acceptance of the prices and description of the products available for sale. Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below. In all cases, the online provision of the bank card number and the final validation of the order by the Customer will constitute proof of the order and payable amounts for the products selected in the order. ORDER CONFIRMATION
An email is automatically sent to the Customer to confirm the order has been taken provided that the email address indicated in the registration form does not contain an error.
The Customer must verify the completeness and conformity of the information he provides to Élhée. The latter cannot be held responsible for possible entry errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for reshipment will be the responsibility of the Customer.

ORDER TRACKING
The Customer can consult the status of their order at any time by consulting the “My account” section on the elhee.com website. This tracking allows the Customer to know the processing status of their order, but also the shipping or delivery status of their packages. This latter delivery tracking is carried out in interface with the carriers' Internet tracking means. Élhée cannot therefore be held responsible for unavailability or errors that may affect the information provided by its carriers. Élhée nevertheless strives to make this information as clear as possible and to make transport as reliable as possible with its carriers. The Customer can contact Élhée Customer Service at any time to be informed of the progress of their order.

PROOF OF ORDER
The computerized records, kept in the computer systems of the Élhée company under reasonable security conditions, will be considered as proof of communications, orders and payments made between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

ARTICLE 5: PRODUCT INFORMATION

PRODUCT FEATURES
The information, characteristics, photographs and graphics presented on the elhee.com site or in emails sent by Élhée are presented with the greatest possible accuracy. Each product sheet presents the essential characteristics of the product selected in accordance with article L.111-1 of the Consumer Code. This information is intended, without being exhaustive, to inform the Customer as completely as possible on the essential characteristics of the products. PRODUCT AVAILABILITY
Élhée only undertakes to honor orders received within the limits of available stocks of the products or within the limits of stocks available from its suppliers. Élhée reserves the right to modify the assortment of products depending in particular on the constraints imposed by its suppliers. The shipping times indicated in the descriptive sheets are indicative times when the product(s) are not available in Élhée stocks. They may therefore undergo variations for which the Customer will be informed by Élhée in its order tracking in the event of a slight delay or by email in the case of a prolonged delay.

If Élhée cannot obtain an ordered product from its suppliers, the company will notify the customer of the expected delay by email. The latter may then request reimbursement of the sums paid within 14 days at the latest of their payment, either the exchange of the unavailable product for another product, or the cancellation of the order. No cancellation penalty will be applied for such order cancellation. No cancellation compensation (apart from the full refund of the order) may also be requested, such unavailability resulting from the time limit for updating these unavailabilities.

Élhée cannot be held responsible for non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications, flooding. , fire.

ARTICLE 6: PRICE

Prices are indicated in euros “All Taxes Included” and are only applicable on the date of sending validation of the order by the Customer. The prices do not take into account delivery costs, gift wrapping costs, possible promotional offers and personal discounts, indicated before final validation of the order.

The prices take into account the French VAT applicable on the day of the order and any change in the legal VAT rate will be automatically reflected in the price of the products presented on the site, on the date stipulated by the implementing decree.

However, prices cannot be modified once the Customer's order has been placed.
Likewise, if one or more taxes or contributions, particularly environmental ones, were to be created or modified, either up or down, this change may be reflected in the selling price of the products on the elhee.com site.

Orders to countries outside the European Union are not subject to French VAT. The prices indicated on the site for these orders are excluding taxes and therefore do not take into account VAT. However, these orders are subject to any taxes and customs fees of the country of destination.

ARTICLE 7: PAYMENT

MEANS OF PAYMENT
The Customer can pay for their order online by bank card (Carte Bleue, Visa, Eurocard-Mastercard, Bancontact), or by Paypal. The Customer guarantees Élhée that he has the necessary authorizations to use the payment method chosen by him, when validating the order form. The debit of purchases from the Customer's account is made at the time of processing the order.

Élhée implements all necessary means to ensure the security and confidentiality of data transmitted online. For this purpose, the site uses a secure SSL (Secure Socket Layer) payment method which allows the encryption of your bank details during their transmission over the network. The company Élhée reserves the right to suspend all order management and delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment. BILL
The order form that the Customer establishes online or the order confirmation sent by email to the Customer by Élhée does not serve as an invoice. The Customer has the original invoice in his online account . The invoice is not attached to the package. Élhée keeps an electronic copy of each invoice.
In the case of delivery to an address different from the billing address, the invoice is in any case only available in the online order tracking of the Customer's account.

TRANSFER OF OWNERSHIP
Élhée remains the owner of the Products delivered until their full payment by the Customer. The above provisions do not prevent, upon delivery of the Products, the transfer to the Customer of the risks of loss or deterioration of the Products subject to retention of title as well as the damage that they could cause.

ARTICLE 8: DELIVERY

DELIVERY AREAS
The geographical delivery area for the Élhée store's offer is as follows:

DELIVERY SERVICES
The products are delivered to the address indicated by the Customer on the order form. The Customer must verify the completeness and conformity of the information he provides to Élhée. The latter cannot be held responsible for possible entry errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for reshipping the order will be entirely the responsibility of the Customer.
Élhée cannot be held responsible for delivery delays due to errors or disruptions attributable to carriers (including in particular in the event of a total or partial strike of postal services and means of transport and/or communications).

SHIPPING TIMES
Orders placed online via the elhee.com website are collected every day from Monday to Friday, except public holidays. Élhée does its utmost to process and ship within 1 working day, however the processing and preparation time for an order may be extended depending on the items and last between 1 and 5 working days. Upon receipt of the shipping confirmation email, the Customer can take into account the delivery times of the carriers announced below. Élhée informs its Customers that these shipping times do not include Saturdays, Sundays and public holidays.
In the case of an order which includes one or more unavailable products as well as one or more available products, Élhée ships the order upon receipt of all the products which constitute the order. If the Customer wishes to receive immediately available products as quickly as possible, he is advised to isolate these items in a separate specific order.

TRANSPORT TIMES
Transport times depend on the carrier chosen by the Customer and the place of delivery.
Élhée informs Customers for information purposes of the deadlines announced to it by the chosen carrier. Shipping costs are calculated based on the country of delivery at the time of shopping and are definitively confirmed based on the mode of transport and delivery destination chosen, before final validation of the order. However, Élhée informs its Customers that the announced deadlines do not include Saturdays, Sundays and public holidays.

DELIVERY TIME Delivery times may be as follows:

  • If the products are available, the delivery time is equal to the time indicated when taking the order in the delivery method section.
  • If the products are not available and therefore on order, the delivery time is equal to the time indicated in the product availability section.

If it turns out that the shipping deadline cannot be met, a new deadline will then be communicated to the Customer, based on the data known by Élhée. In this case, a proposal to cancel the order, credit or refund will also be made to the Customer.

MEANS OF DELIVERY IN METROPOLITAN FRANCE

Standard Delivery by Colissimo (deadline usually 48h/72h)
This delivery method allows the Customer to receive their package within 48 hours of dispatch thanks to the Post Office and the Colissimo service (excluding order processing and preparation time which can take from 1 to 5 working days). Deliveries are made from Monday to Friday morning, except public holidays. The costs incurred for this option depend on the weight and total volume of the items ordered. The package is picked up by the Post Office and delivered to the delivery address indicated by the Customer. In the event of absence during delivery, a delivery notice is left at the delivery address indicated by the Customer, which allows the latter to collect their package from the nearest post office. Packages are held at the Post Office for 15 calendar days. In the event of non-collection within the time limits set by the carrier, the products will be returned to Élhée which reserves the right to reimburse the price of the products, the shipping costs remaining the responsibility of the Customer.

Delivery by UPS and DHL (deadline usually within 24 hours)
This delivery method allows the Customer to receive their package within 24 hours of shipment thanks to UPS and DHL (excluding order processing and preparation time which can take 1 to 2 working days). Deliveries are made Monday to Friday, except public holidays. The costs incurred for this option depend on the weight and total volume of the items ordered.
The package is picked up by UPS or DHL and delivered to the delivery address indicated by the Customer. The Customer must ensure that when ordering the access conditions of the place of delivery (code, building, floor, door, etc.), as well as a telephone number where the Customer can be easily reached. In the event of absence, the delivery person leaves a calling notice indicating his next visit. The Customer can call UPS or DHL customer service to arrange a new delivery date that is more convenient for them. After 3 unsuccessful visits to the delivery address, the package is automatically returned to Élhée, which reserves the right to reimburse the price of the products.
The delivery times that we indicate are indicative and those generally observed. No refund of shipping costs will be made in the event of delivery taking longer than those indicated.

DELIVERY MEANS OUTSIDE METROPOLITAN FRANCE
In Europe and abroad, delivery is made via various carriers: Colissimo, UPS, etc. The costs incurred depend on the country of destination, the weight and the total volume of the selected items. The costs and deadlines are indicated to the Customer before the final validation of his order.
Orders to countries outside the European Union are not subject to French VAT. However, they are subject to possible taxes and customs fees in the country of destination. These costs and the related formalities are the responsibility of the customer/recipient. They must be paid directly to the carrier upon delivery.

CONDITIONING
The products are packaged in such a way as to comply with current transport standards, and to ensure optimal protection of the products during delivery. The Customer is asked to respect these same standards when returning a product, whether during after-sales service, or when returning for convenience. CUSTOMER RESPONSIBILITY FOR CHECKING PACKAGES UPON RECEIPT

CARRIER RELATED DELIVERY DELAYS
In the case of a delay in delivery compared to the deadlines announced by the carriers, the Customer must first contact the carrier or its distribution office in the case of La Poste, to see if the package is not pending. If necessary, the Customer can contact Élhée Customer Service by telephone or email in order to open a dispute or investigation file to search for the package.
Sometimes packages are lost by carriers. The deadlines imposed by the carriers require the Customer to declare the loss within 10 days following receipt of the shipping notice from Élhée. Under these conditions, Élhée is responsible for making the necessary complaints to the carrier concerned. Once the complaint and the opening of an investigation have been made, it may take 3 to 4 weeks to receive a response from the carrier.
If the package is found, it will be redirected immediately to the Customer's home. In the event that the package is not found, the Customer may then request the return of the same Product (within availability times), at Élhée's expense, or reimbursement of the amount paid. If the Product(s) ordered were no longer available at that time, Élhée will reimburse the amount of the Products affected by the carrier's loss.

DAMAGED PACKAGES
The Customer must check the condition of the package in front of the carrier and make the necessary reservations on the delivery slip in the event of partial or total damage. In the absence of reservations, the product is deemed accepted by the Customer and cannot be the subject of any dispute concerning its delivery. The Customer must inform Élhée by email as soon as possible, so that Élhée can take the necessary measures as quickly as possible.

ARTICLE 9: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

9.1 Legal withdrawal period
In accordance with the provisions of articles L.221-16 et seq. of the Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or withdrawal of the products to exercise his right. legal withdrawal and thus notify Élhée of its intention to return said product. If the products may be subject to the legal right of withdrawal, the Customer exercising his right of withdrawal under the conditions provided for in this article in terms of time limit and terms of return of the products, will be able to obtain a refund of the returned products.

The refund will be made by the same means of payment as that used by the Customer for the initial transaction. The refund will be made as soon as possible and at the latest within 14 days following the effective exercise of the right of withdrawal by the Customer. This period may, however, be extended by Élhée until receipt by Élhée of the goods returned by the Customer to the address indicated on the return slip, or until receipt by Élhée of proof of shipment of the Items by the customer. When the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended until the first following working day.

In accordance with article L.221-23 of the Consumer Code, the right is exercised by returning the product, at Élhée's expense for returns from Metropolitan France, otherwise the shipping costs remain at the expense of responsibility of the Customer.

Customers can benefit from a prepaid return voucher in the event of non-conformity of the products delivered with the order (in this case, the return costs will be borne by Élhée).

The right of withdrawal is exercised under the same conditions from the time of ordering and before delivery.

9.2 Conventional withdrawal period
In order to ensure the satisfaction of its Customers, Élhée accepts returns by post to the address indicated by Customer Service or on the Delivery slip for the Item concerned, within a period longer than the aforementioned legal withdrawal period. As such, the Customer has fourteen (14) days from the date of receipt of their order to withdraw and return their products. Product returns beyond this deadline will not be accepted.

9.4 Conditions for exercising the right of withdrawal

Only products returned in their original packaging in perfect condition for resale will be accepted. Consequently, returns of used products, as well as damaged boxes, will be refused.

Withdrawal can never be exercised if the products delivered are products that have been damaged or used. Likewise, these products returned incomplete, damaged or soiled by the Customer will not be returned or exchanged.

The products must also be accompanied by the order number, shown either on the return slip, sent with the delivered products signed by the Customer, or on any other document. The Customer is informed that the use of the return voucher facilitates the processing of the return by Élhée. The Customer is therefore invited to make use of this return voucher.

The Customer's liability may only be incurred in the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and, where applicable, the proper functioning of the products.

Reimbursement in the event of use of the right of withdrawal will be made by the same means of payment as that used by the Customer for the initial transaction, unless specifically indicated by the Customer.

ARTICLE 10: GUARANTEES, CLAIMS, MEDIATION

GUARANTEE
In accordance with article 4 of decree n°78-464 of March 24, 1978, the provisions hereof cannot deprive the Customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the item sold. .

ARTICLE 12: FORCE MAJEURE
