GENERAL TERMS AND CONDITIONS OF SALE

PREAMBLE

This website is operated by Élhée SAS, whose registered office is located at 4 rue Clara Belle, 38160 Saint-Marcellin, France, and registered with the Grenoble Trade and Companies Register under number 842 142 028.
These general terms and conditions of sale apply to all orders placed with Élhée for all items offered on the elhee.com website by non-commercial individuals (hereinafter referred to as the General Terms and Conditions of Sale). Consequently, placing an order for any product offered for sale on the Élhée website implies full and unreserved acceptance of these General Terms and Conditions of Sale, which the Customer acknowledges having read prior to placing their order. Élhée reserves the right to modify these General Terms and Conditions of Sale at any time. However, the General Terms and Conditions of Sale applicable to an order placed by a Customer on the Élhée website are those accepted by the Customer at the time of placing their order.



ARTICLE 1: ENTIRETY

These General Terms and Conditions of Sale constitute the entire agreement between the parties. By placing an order, the Customer is deemed to have accepted all the provisions of these General Terms and Conditions of Sale without reservation.


ARTICLE 2: PURPOSE

These General Terms and Conditions of Sale are intended to define the rights and obligations of the parties in the context of the online sale of goods offered by the company Élhée to the Customer, from ordering to delivery, including payment and the use of services made available by Élhée.


ARTICLE 3: SCOPE OF APPLICATION

These General Terms and Conditions of Sale govern the sale of products on the day the order is placed online by the Customer.



ARTICLE 4: ORDER

CAPACITY TO CONTRACT
Every customer of Élhée declares that they have the legal capacity to enter into a contract under the conditions described below, meaning they are either an emancipated minor or of legal age and not under guardianship as defined in Article 488 of the French Civil Code. Élhée reserves the right to refuse any order from a customer with whom a dispute exists or arises during the processing of an order, particularly a payment dispute.

CUSTOMER ACCEPTANCE OF TERMS AND CONDITIONS
These General Terms and Conditions of Sale can be read directly on the elhee.com website. Upon request, they can also be sent by email. By checking the box "I accept the General Terms and Conditions of Sale" before proceeding to secure payment, the Customer irrevocably accepts these terms and conditions, which can only be challenged in the limited circumstances provided for in these General Terms and Conditions of Sale under the section "Right of Withdrawal." By doing so, the Customer acknowledges having read and understood these General Terms and Conditions of Sale and accepts them.

ORDER PLACEMENT
Individual customers can place their orders with Élhée online 24/7. The ordering process consists of 6 successive steps. Once the products have been selected and the shopping cart validated, the customer must:

  • clearly identify the selected products with the color options, volumes, etc. indicated on the elhee.com website
  • Please specify the quantities requested.
  • to identify oneself either by entering one's email address and password which are strictly personal, or by mentioning all the information usually requested for an online registration.
  • Clearly indicate the information necessary for delivery. This includes, in particular, the precise delivery address as well as any access restrictions to the delivery location (building, floor, entry code, etc.).
  • indicate the chosen delivery method
  • Finally, indicate the chosen payment method.

Once the payment method has been selected, the Customer must proceed to payment of their order on the secure interface, which will formalize in a firm and definitive manner the sales contract that binds them to Élhée.
All orders constitute acceptance of the prices and descriptions of the products available for sale. Any dispute regarding this will be addressed within the framework of a possible exchange and the guarantees mentioned below. In all cases, the online provision of the bank card number and the final validation of the order by the Customer will constitute proof of the order and the obligation to pay the amounts due for the products selected in the order. This validation constitutes a signature and acceptance of all transactions carried out on the elhee.com website.

ORDER CONFIRMATION
An email is automatically sent to the Customer to confirm the order, provided that the email address provided in the registration form is correct.
The Customer is responsible for verifying the completeness and accuracy of the information they provide to Élhée. Élhée cannot be held liable for any data entry errors and the resulting delays or delivery errors. In such cases, all costs incurred for reshipment will be borne by the Customer.

ORDER TRACKING
The Customer can check the status of their order at any time by visiting the “My Account” section on the elhee.com website. This tracking allows the Customer to see the processing status of their order, as well as the shipping or delivery status of their packages. This delivery tracking is done through an interface with the carriers' online tracking systems. Therefore, Elhée cannot be held responsible for any unavailability or errors that may affect the information provided by its carriers. However, Elhée strives to make this information as clear as possible and to ensure the most reliable transport with its carriers. The Customer can contact Elhée Customer Service at any time to be informed of their order's status.

PROOF OF ORDER
The computerized records, stored in Élhée's computer systems under reasonable security conditions, will be considered proof of communications, orders, and payments between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence.



ARTICLE 5: PRODUCT INFORMATION

PRODUCT CHARACTERISTICS
The information, features, photographs, and graphics presented on the elhee.com website or in emails sent by Élhée are presented as accurately as possible. Each product description presents the essential characteristics of the selected product in accordance with Article L.111-1 of the French Consumer Code. This information, while not exhaustive, is intended to inform the Customer as fully as possible about the essential characteristics of the products. The Customer is informed, subject to their rights, of the possibility of a difference in presentation upon delivery resulting from a change in packaging (photographs and illustrations). This difference does not affect the content or characteristics of the product in any way.

PRODUCT AVAILABILITY
Élhée is only obligated to fulfill orders received within the limits of available product stock or the stock available from its suppliers. If a product is unavailable, Élhée will inform the Customer as soon as possible. Élhée reserves the right to modify its product range, particularly due to constraints imposed by its suppliers. Availability may vary throughout the day depending on sales volume. Élhée updates its availability information very frequently. In the event of product unavailability, Élhée will notify the Customer by telephone or email.

A product's unavailability is indicated on the product page and in the shopping cart summary. Products may therefore appear with a shipping time indication such as "In stock" or "Immediate," "4 to 8 days," "1 to 2 weeks," "4 to 6 weeks," "Product unavailable," etc.

The shipping times indicated in the product descriptions are estimates when the product(s) are not currently in stock at Élhée. These times may therefore vary, and the customer will be notified by Élhée in their order tracking in the event of a slight delay, or by email in the case of a significant delay.

If Élhée is unable to obtain an ordered product from its suppliers, the company will notify the customer of the expected delay by email. The customer may then request a refund of the sums paid within 14 days of payment, exchange the unavailable product for another product, or cancel the order. No cancellation fee will be applied for such an order cancellation. No compensation for cancellation (other than a full refund of the order) may be claimed, as such unavailability results from the time required to update stock availability information.

Élhée cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike in particular of postal services and means of transport and/or communications, flood, fire.



ARTICLE 6: PRICE

Prices are shown in euros, inclusive of all taxes, and are applicable only on the date the order is confirmed by the customer. Prices do not include delivery charges, gift wrapping fees, or any promotional offers and personal discounts, which will be indicated before final order confirmation.

Prices include French VAT applicable on the day of the order and any change in the legal VAT rate will be automatically reflected in the price of products presented on the site, on the date stipulated by the implementing decree.

However, prices cannot be changed once the Customer's order has been placed.
Similarly, if one or more taxes or contributions, particularly environmental ones, were to be created or modified, whether increased or decreased, this change may be reflected in the selling price of products on the elhee.com website.

Orders shipped to countries outside the European Union are not subject to French VAT. The prices shown on the website for these orders are exclusive of VAT. However, these orders may be subject to any applicable taxes and customs duties in the destination country.



ARTICLE 7: PAYMENT

PAYMENT METHODS
The Customer can pay for their order online by credit card (Carte Bleue, Visa, Eurocard-Mastercard, Bancontact) or by PayPal. The Customer guarantees to Élhée that they have all necessary authorizations to use the payment method chosen when validating the order. The Customer's account will be debited upon order processing.

Élhée takes all necessary measures to ensure the security and confidentiality of data transmitted online. To this end, the site uses a secure SSL (Secure Socket Layer) payment method, which encrypts your bank details during transmission over the network. You can identify that the transmission is encrypted by the padlock symbol that appears in your browser. The transaction is processed through the CIC bank, which is the only entity with access to the bank details provided on the site at the time of payment.

Élhée reserves the right to suspend order processing and delivery in the event of a payment authorization refusal by officially accredited organizations or in the event of non-payment. Élhée also reserves the right to refuse to deliver or fulfill an order from a customer who has not fully or partially paid for a previous order or with whom a payment dispute is pending.

As part of an order verification procedure designed to ensure that no one is using another person's bank details without their knowledge, the Customer may be asked to send Élhée a copy of their identity document and proof of address by fax or email. The order will only be validated after our services have received and verified the documents sent. If these documents are not received within 15 days of placing the order, the order will be automatically cancelled.

BILL
The order form that the Customer completes online or the order confirmation sent by email to the Customer by Élhée does not constitute an invoice. The customer has access to the original invoice in their online account . The invoice is not included in the package. Élhée keeps an electronic copy of each invoice.
In the case of delivery to an address different from the billing address, the invoice is in all cases only available in the online order tracking of the Customer's account.

TRANSFER OF OWNERSHIP
Élhée retains ownership of the delivered Products until full payment is received from the Customer. The above provisions do not preclude the transfer to the Customer, upon delivery of the Products, of the risks of loss or damage to the Products subject to retention of title, as well as any damage they may cause.


ARTICLE 8: DELIVERY

DELIVERY AREAS
The geographical delivery area for the Élhée store's offer is as follows:
Metropolitan France, Corsica and Monaco and certain countries in Europe and the rest of the world.
The Customer can contact Élhée Customer Service for more information regarding delivery conditions to a specific country. Orders destined for countries outside the European Union are not subject to French VAT. However, they may be subject to taxes and customs duties in the destination country. These costs and related formalities are the responsibility of the customer/recipient and must be paid directly to the carrier upon delivery. The Customer is also responsible for verifying the import regulations for the ordered products in the country of delivery. We recommend contacting the customs service for further information.

DELIVERY SERVICES
Products are delivered to the address provided by the Customer on the order form. The Customer is responsible for verifying the completeness and accuracy of the information provided to Élhée. Élhée cannot be held liable for any data entry errors and the resulting delays or delivery errors. In such cases, all costs incurred for reshipping the order will be borne entirely by the Customer.
Élhée cannot be held responsible for delivery delays due to errors or disruptions attributable to carriers (including in particular in the event of a total or partial strike of postal services and means of transport and/or communications).

SHIPPING TIMES
Orders placed online via the elhee.com website are processed daily from Monday to Friday, excluding public holidays. Élhée makes every effort to process and ship orders within one business day; however, order processing and preparation time may be longer depending on the items and can take between one and five business days. Upon receiving the shipping confirmation email, the customer should refer to the carrier delivery times indicated below. Élhée informs its customers that these delivery times do not include Saturdays, Sundays, or public holidays.
In the case of an order containing one or more unavailable products as well as one or more available products, Élhée will ship the order as soon as all the products included in the order are received. If the Customer wishes to receive the immediately available products as quickly as possible, they are advised to place a separate order for those items.

TRANSPORT TIMES
Shipping times depend on the carrier chosen by the Customer and the delivery location.
Élhée provides customers with indicative delivery times as provided by their chosen carrier. Shipping costs are calculated based on the delivery country at the time of purchase and are finalized according to the selected shipping method and delivery destination before final order confirmation. However, Élhée informs its customers that the estimated delivery times do not include Saturdays, Sundays, or public holidays.

DELIVERY TIME Delivery times may be as follows:

  • If the products are available, the delivery time is equal to the time indicated when placing the order in the delivery method section.
  • If the products are not available and therefore on order, the delivery time is equal to the time indicated in the product availability section.

If it turns out that the shipping deadline cannot be met, a new deadline will be communicated to the Customer, based on the information available to Élhée. In this case, the Customer will also be offered the option of order cancellation, a credit note, or a refund.

DELIVERY METHODS IN METROPOLITAN FRANCE

Standard delivery via Colissimo (usually 48-72 hours)
This delivery method allows the Customer to receive their package within 48 hours of shipment via the postal service and the Colissimo service (excluding order processing and preparation time, which can take 1 to 5 business days). Deliveries are made Monday through Friday mornings, excluding public holidays. The cost of this option depends on the total weight and volume of the items ordered. The package is handled by the postal service and delivered to the delivery address provided by the Customer. If the Customer is absent at the time of delivery, a delivery notice will be left at the address provided, allowing them to collect their package from the nearest post office. Packages are held at the post office for 15 calendar days. If the package is not collected within the time limit set by the carrier, the products will be returned to Élhée, which reserves the right to refund the price of the products, with the original shipping costs remaining the Customer's responsibility.

Delivery via UPS and DHL (usually within 24 hours)
This delivery method allows the Customer to receive their package within 24 hours of shipment via UPS and DHL (excluding order processing and preparation time, which can take 1 to 2 business days). Deliveries are made Monday through Friday, excluding public holidays. The cost of this option depends on the total weight and volume of the items ordered.
The package is handled by UPS or DHL and delivered to the delivery address provided by the Customer. When placing their order, the Customer must ensure they accurately provide information regarding access to the delivery location (code, building, floor, door number, etc.), as well as a telephone number where they can be easily reached. If the Customer is absent, the delivery driver will leave a delivery notice indicating their next attempt. The Customer can then contact UPS or DHL customer service to schedule a new, more convenient delivery date. After three unsuccessful delivery attempts, the package will be automatically returned to Élhée, which reserves the right to refund the price of the products.
The delivery times we indicate are estimates and are those generally observed. No refund of shipping costs will be issued if delivery takes longer than the stated timeframe.

DELIVERY METHODS OUTSIDE OF METROPOLITAN FRANCE
In Europe and internationally, delivery is handled by various carriers: Colissimo, UPS, etc. Shipping costs depend on the destination country, the weight, and the total volume of the selected items. Costs and delivery times are provided to the customer before final order confirmation.
Orders shipped to countries outside the European Union are not subject to French VAT. However, they may be subject to taxes and customs duties in the destination country. These costs and related formalities are the responsibility of the customer/recipient and must be paid directly to the carrier upon delivery.
The customer is also responsible for verifying the import regulations for the ordered products in the country of delivery. We recommend contacting customs for further information.

PACKAGING
Products are packaged to comply with current transport standards and to ensure optimal protection during delivery. Customers are asked to adhere to these same standards when returning a product, whether for after-sales service or for a change of mind. In the event of a product return, if we find that the product is damaged due to inadequate packaging, Élhée may decide to only partially refund the product or refuse a refund altogether if the product cannot be resold in its current condition.

CUSTOMER RESPONSIBILITY FOR CHECKED PACKAGES UPON RECEIPT
Élhée reminds customers that it is their responsibility to inspect their packages upon delivery in the presence of the delivery person and to immediately notify the carrier and Élhée Customer Service of any anomalies observed (impact, damaged package, delivery date not in accordance with the normal delivery service timeframe). If such issues are not noted on the delivery slip presented to the customer by the carrier, Élhée will not be able to accept any subsequent claims regarding the condition of the package(s).

DELIVERY DELAYS RELATED TO THE CARRIER
In the event of a delivery delay beyond the timeframe announced by the carrier, the Customer should first contact the carrier or, in the case of La Poste (the French postal service), their local distribution office to check if the package is being held there. If necessary, the Customer can then contact Élhée Customer Service by phone or email to open a dispute or investigation case to locate the package.
Occasionally, packages are lost by carriers. Due to carrier deadlines, the customer must report the loss within 10 days of receiving the shipping notification from Élhée. In such cases, Élhée will handle the necessary claims with the carrier. Once the claim has been filed and an investigation initiated, it may take 3 to 4 weeks to receive a response from the carrier.
If the package is found, it will be immediately reshipped to the Customer's address. If the package is not found, the Customer may request a replacement of the same Product (subject to availability), at Élhée's expense, or a refund of the amount paid. If the ordered Product(s) are no longer available at that time, Élhée will refund the amount for the Product(s) lost by the carrier.

DAMAGED PACKAGE
The Customer must check the condition of the package in the presence of the carrier and note any damage, whether partial or total, on the delivery slip. If no damage is noted, the product is considered accepted by the Customer and no claims regarding its delivery will be accepted. The Customer must inform Élhée by email as soon as possible so that Élhée can take the necessary steps promptly.



ARTICLE 9: RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE

9.1 Statutory withdrawal period
In accordance with Articles L.221-16 et seq. of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or collection of the products to exercise their legal right of withdrawal and thus notify Élhée of their intention to return the product. If the products are eligible for the legal right of withdrawal, the Customer exercising their right of withdrawal under the conditions set out in this article, in terms of the time limit and return procedures, will be entitled to a refund for the returned products.

The refund will be issued via the same payment method used by the Customer for the initial transaction. The refund will be processed as quickly as possible and no later than 14 days after the Customer effectively exercises their right of withdrawal. This period may, however, be extended by Élhée until Élhée receives the returned merchandise from the Customer at the address indicated on the return slip, or until Élhée receives proof of shipment of the items from the Customer. When the fourteen (14) day period expires on a Saturday, Sunday, or public holiday, it is extended to the next business day.

In accordance with Article L.221-23 of the Consumer Code, the right is exercised by returning the product, the shipping costs remain the responsibility of the Customer.

Customers can benefit from a prepaid return voucher in the event of non-conformity of the delivered products with the order (in this case, the return costs will be borne by Élhée).

The right of withdrawal can be exercised under the same conditions from the time of ordering and before delivery.

9.2 Conventional withdrawal period
Committed to ensuring customer satisfaction, Élhée accepts returns by mail to the address provided by Customer Service or on the delivery slip for the item in question, even if the legal withdrawal period is longer than the aforementioned period. Therefore, the customer has fourteen (14) days from the date of receipt of their order to withdraw and return the products. Product returns after this period will not be accepted.

9.4 Procedures for exercising the right of withdrawal


Return requests should be made by contacting Customer Service via email: contact@elhee.com, providing the following information:

  • Please provide the corresponding order number.
  • The reason for the withdrawal
  • the name and address of the Client

A prepaid return label will be sent to the Customer to return unused products in their original packaging.

If the specified deadlines are not met, Élhée will not be able to reimburse the Client.
Only products returned in their original packaging and in perfect condition for resale will be accepted. Therefore, returns of used products, as well as damaged boxes, will be refused.

The right of withdrawal cannot be exercised if the delivered products have been damaged or used. Similarly, products returned incomplete, damaged, or soiled by the customer will not be accepted for return or exchange.

The products must also be accompanied by the order number, which can be found either on the return slip, included with the delivered products and signed by the Customer, or on any other document. The Customer is advised that using the return slip facilitates the processing of the return by Élhée. The Customer is therefore encouraged to use this return slip.

The Customer shall only be liable in the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and, where applicable, the proper functioning of the products.

Refunds in the event of exercising the right of withdrawal will be made using the same payment method as that used by the Customer for the initial transaction, unless otherwise specified by the Customer.



ARTICLE 10: GUARANTEES, CLAIMS, MEDIATION

GUARANTEE
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions herein cannot deprive the Client of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the thing sold.

The Customer is expressly informed that the company Élhée is not the manufacturer of the products presented within the framework of the elhee.com website, within the meaning of law n°98-389 of 19 May 1998 and relating to liability for defective products.
Consequently, in the event of damage to a person or property caused by a defective product, the Customer may only seek redress from the product's manufacturer, based on the information provided on the product packaging. Furthermore, the company reiterates that the products, services, and information offered by Élhée are in no way a substitute for constant adult supervision. Élhée cannot be held liable for any failure to comply with the laws of the country where the products are delivered. It is the Customer's responsibility to check with local authorities regarding the import or use of the products or services they intend to order.

COMPLAINTS / MEDIATION
All complaints must be submitted in advance by email via the "Customer Service" section of the Website. Contact address: contact@elhee.com

If applicable, the refund will be issued within 14 days of receipt of the item by Élhée, according to the payment method chosen during the order, either to the bank card used for payment or to the customer's PayPal account. These provisions do not preclude the aforementioned right of withdrawal.

Furthermore, in accordance with Article L.616-2 of the French Consumer Code, Élhée informs the Customer of the existence of the online platform established by the European Commission, which aims to collect any complaints arising from online purchases made by European consumers and then forward the cases received to the competent national mediators. ARTICLE 11: LIABILITY

The products offered comply with current French legislation and applicable standards in France. Élhée cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is the Customer's responsibility to check with local authorities regarding the import or use of the products they intend to order.

Élhée cannot be held responsible for any inconvenience or damage related to the use of the internet, including but not limited to service interruptions, the presence of computer viruses or external intrusions, and more generally any cases classified as force majeure or acts of third parties by the courts.
Hyperlinks may lead to sites other than fr.Élhée.com. Élhée disclaims all responsibility in the event that the content of these sites violates applicable laws and regulations.


ARTICLE 12: FORCE MAJEURE

Neither party shall have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by a fortuitous event or force majeure.
Events of force majeure shall be considered as any irresistible event or circumstance, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.
The party affected by such circumstances shall notify the other party within ten working days of the date on which it became aware of them.
The two parties will then meet within one month, unless prevented by force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will continue.
If the force majeure event lasts for more than three months, these terms and conditions may be terminated by the affected party.
Specifically, the following are considered cases of force majeure or fortuitous events, in addition to those usually recognized by the jurisprudence of French courts and tribunals:
– Total or partial strikes, internal or external to the company, blockage of means of transport or supplies for any reason whatsoever, governmental or legal restrictions, computer failures, earthquakes, fires, storms, floods, lightning;
– The interruption of telecommunications networks or difficulties specific to telecommunications networks external to the Clients.



ARTICLE 13: PERSONAL DATA

Site visitors or customers elhee.com Users have the right to access, modify, rectify, and delete their personal data at any time, in accordance with Article 34 of the French Data Protection Act of January 6, 1978. When registering a customer, placing an order, or during other specific operations, Élhée offers visitors and customers the option to receive its newsletters, promotional offers, and/or to subscribe to be informed of its exclusive sales. Visitors and customers can modify their subscription at any time through their personal account or via the unsubscribe link at the bottom of the email newsletters.

Élhée undertakes to take into account in an effective manner the changes to subscription and unsubscription to commercial emails distributed by it as soon as possible depending on the processing required.

Élhée may also offer its visitors or customers the opportunity to receive promotional offers from its partners. Élhée may, for commercial purposes, share the identity and contact information of its users or customers with its business partners, but only if they have consented to the disclosure of their personal data. Users and customers can modify their preferences at any time on the Élhée website.

Élhée uses data collection systems such as cookies. A cookie is a computer file stored on the user's hard drive. Cookies allow the website to recognize a user's previous visit and to link the user to their personal data left on the site, particularly for identifying the shopping cart.
